Shopping+giving (“we”, “us”, “our”) is a trading style of Disability Talk, a company registered in England and Wales (company number of 07783439) and a registered office address of 38 Brackley Road, London, Greater London, W4 2HN.

By using our website, product or services, you are agreeing to accept our terms and conditions.

Donations

Shopping+giving is a way to raise donations for your chosen charity. You will have been directed to our site from your chosen charity. You can raise funds on Shopping+giving as we have agreements with certain retailers, either directly or, more typically, through affiliate networks (also referred to as retailers throughout this document). As part of these agreements once you take an action agreed by the retailer (normally a purchase but occasionally requesting a quotation or the like), retailers pay a commission to Shopping+giving and we pay an agreed proportion of this money to the charity who directed you to the Shopping+giving website.

The commission can be a percentage of the sale amount or a fixed amount. This will be shown on the Shopping+giving website.

All values we display refer to the amount of commission which will be passed on to the charity in the form of a donation. For example, if a retailer offers a commission rate of 5.00%, then a donation rate of 2.50% is displayed.

Relationships between us and each retailer is usually managed by an affiliate network. Affiliate networks work with the retailers to provide the tracking and reporting mechanics and are responsible for the invoicing and collection of commissions owed.

Donations are only added to your account once they have been reported to us by the retailer. We cannot track your purchases and cannot be held responsible if a purchase is not reported to us and therefore isn't added to your account. However, we can contact the retailer to request the commission if needs be. There will be a delay between the purchase date and commission being paid to us and subsequently the charity to allow for potential cancellations.

Donation amounts and eligibility of donations

We list the donation rates available for each retailer, along with any terms and conditions. We try to ensure that rates are always accurate but there are times that these may be out of date. We cannot be held accountable if the amount donated differs from the amount advertised.

Commission is not usually paid on VAT, postage or delivery charges.

Some retailers may have different commission rates for different products, or may have different rates for new customers as opposed to existing customers. Whether a customer is 'new' or 'existing' is dependent on your relationship as a user with the retailer and is not affected by our involvement. Whilst commission is normally available on all products, in some cases a retailer may have exclusions which we may or may not stipulate on the website.

Questions or disputes regarding purchases

If you have any queries about your purchase, you should contact the retailer. Shopping+giving cannot act on behalf of the retailer. If you have any queries about your donation, then you should contact us; the retailer will not be able to help on such queries.

If you decide to buy goods or services from a retailer, this is a private agreement between you and the retailer. Any issue, defect or fault with goods or services you buy from a retailer is the sole responsibility of the retailer from whom you bought the goods or services. Shopping+giving is not responsible for any negative experiences you may have with a retailer or with the products or services purchased, or with services linked with your purchase such as delivery or after-sales support.

Unreported and incorrect donations

If you think that a purchase has not been recorded correctly, please contact us. Do not contact the retailer directly.

In all cases, we will do our best to reach a positive outcome where we are paid a manual commission by the retailer, from which we will donate to the charity. However, in some cases, a retailer may not agree in which case we will not be held responsible.

In all cases, the decisions made by us, the retailer or the affiliate network are final.

Charity payments and timings

Payments are made to charities once we have received the commission for a purchase in full and the charity requests a withdrawal. This commission generally must go through the relevant affiliate network, who will then pass the commission on to Shopping+giving. This process can several months. We are not responsible for the time it takes.

Use of funds by charities

We have no input into how the charity uses the money they raise. Each charity reserves the right to use the funds raised for any purpose as they see fit.

Trademarks

The name Shopping+giving, www.shoppingandgiving.com and the Shopping+giving logo are the property of Disability Talk. These marks and URLs may not be used in connection with any product or service that is not provided by Shopping+giving, or in any manner that may cause confusion, or in any way that may disparage or discredit Shopping+giving or Disability Talk.

Other trademarks, service marks or logos that appear on our website - including, but not limited to, those of retailers - are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of the trademark owner.

Changes and additions

We make every effort to ensure that Shopping+giving is available all the time but we reserve the right to change, suspend or stop all or any part at any time. Any changes or additions introduced will be subject to these Terms and Conditions.

Indemnification

You agree to indemnify Shopping+giving and Disability Talk against any loss, liability, claim, demand, damage or expense (including legal fees) that may arise in connection with the use of our website. We are careful to ensure that the data provided on this site is correct. However, we cannot offer a guarantee of the accuracy or completeness of any information on the site and do not accept liability for any errors or omissions. We do not accept any liability for any damage or loss which may arise from the use of our website however this has been caused.

Linking from external websites

Charity websites link to our website; however, it is not permitted for pages to be loaded into frames on other third party sites, or for our pages to be linked to from any websites that contain material which could be construed as offensive or illegal.

Links to external websites

Shopping+giving links to many other third-party websites for information and as a service to our users, including the websites of our affiliated retailers. These external websites are beyond our control and we are not responsible for the content of any linked site.

By linking to another site, we are not making endorsements or recommendations and we accept no liability regarding the content of external sites. We do not guarantee that links will work all the time and we are not responsible for the availability or content of linked pages.

UK Law

These terms and conditions shall be governed by the laws of England. Any dispute arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of England.
